What families have the right to know
You have the right to know what services your loved one receives and why.
You have the right to see their service plan and participate in planning meetings.
You have the right to receive written notice before services are changed or cut.
You have the right to appeal any decision that affects their services.
You have the right to request records related to their care.
If services are reduced or cut
Ask for written notice
You are legally entitled to a written notice explaining why services changed and by how much. If you have not received one, request it in writing immediately and keep a copy.
Request a fair hearing within 90 days
You have 90 days from the date of the notice to request a fair hearing. Do this in writing. Keep a copy of everything you send.
Ask about continuing services during appeal
In many cases your loved one can keep receiving services during the appeal process. Ask Nebraska DHHS about 'aid pending appeal' — sometimes called continuation of benefits.
Get free legal help
Disability Rights Nebraska provides free legal assistance to people with disabilities and their families. Call 1-800-422-6691. You do not need money to fight a service reduction.
Document everything
Keep records of every conversation, letter, and decision. Write down dates, names, and what was said. Get things in writing whenever possible.
