Terms of Service

1. Acceptance of Terms

By accessing or using Goliath ATLAS ("the Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Platform. These Terms apply to all users, including organization owners, administrators, advocates, peer support specialists, and staff members. Use of the Platform constitutes acceptance of these Terms on behalf of yourself and your organization.

2. About Goliath ATLAS

Goliath ATLAS is a professional software platform operated by Goliath Advocacy, LLC, a Nebraska limited liability company. The Platform provides tools for disability advocates, peer support specialists, special education teams, and vocational rehabilitation professionals, including participant management, IEP tracking, peer support documentation, wellness planning, vocational rehabilitation tools, coordination networks, document management, training, and related services.

3. Account Registration and Organizations

To use the Platform, you must create an account associated with an organization. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Organizations are responsible for all activity that occurs under their organizational account.

Organization owners are responsible for managing user access, roles, and permissions. You agree to provide accurate and complete information when creating your account and to promptly update such information if it changes.

You must be at least 18 years of age and a licensed or credentialed professional (or supervised staff member of such an organization) to create an account. The Platform is not intended for use by members of the general public.

4. Free Trial

Goliath ATLAS offers a 30-day free trial with full access to all Platform features. No credit card is required to begin a trial. At the end of the trial period, you must select a paid subscription plan to continue using the Platform. Trial accounts that are not converted to paid plans will be deactivated. Your data will be retained for 30 days after trial expiration, after which it will be permanently deleted.

5. Subscription and Billing

The Platform is offered on a subscription basis with the following plans: Solo, Practice, Agency, and Enterprise. Plan details, pricing, and feature inclusions are described at goliathatlas.app/settings/billing. By subscribing, you authorize Goliath Advocacy, LLC to charge the applicable fees to your payment method on a recurring basis.

Subscription fees are non-refundable except as required by applicable law. Annual subscriptions are billed upfront for the full year. Monthly subscriptions are billed on the same date each month.

We reserve the right to modify pricing with at least 30 days advance written notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing.

If payment fails, we will attempt to collect payment for up to 14 days before suspending access. You will be notified of any payment failures by email.

6. Privacy, Confidentiality, and Compliance

The Platform stores sensitive participant information, including personally identifiable information (PII) related to individuals with disabilities, minors, and individuals receiving mental health and peer support services. You agree to:

  • Use participant data only for legitimate professional and service purposes
  • Maintain appropriate confidentiality standards required by your role and applicable law
  • Comply with FERPA, HIPAA, 42 CFR Part 2, and other applicable privacy regulations
  • Obtain any required participant or guardian consent before entering data into the Platform
  • Not share, sell, or disclose participant information to unauthorized parties
  • Notify your organization administrator immediately of any suspected data breach
  • Ensure that use of the Coordination Network feature complies with applicable consent requirements

7. AI-Generated Content

The Platform includes a Communications Builder feature that uses artificial intelligence to generate draft letters, emails, and phone scripts. You acknowledge and agree that:

  • AI-generated content is a draft only and must be reviewed before use
  • You are solely responsible for reviewing, editing, and verifying all AI-generated content
  • Goliath Advocacy, LLC makes no warranty as to the accuracy, completeness, or legal sufficiency of AI-generated content
  • AI-generated content does not constitute legal advice
  • You will not send AI-generated communications without human review

8. Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable local, state, federal, or international law or regulation
  • Upload or transmit any content that is unlawful, harmful, or discriminatory
  • Attempt to gain unauthorized access to any part of the Platform or its related systems
  • Interfere with or disrupt the integrity or performance of the Platform
  • Use automated tools to scrape, crawl, or extract data from the Platform
  • Impersonate any person or entity or misrepresent your affiliation or credentials
  • Enter false or fabricated participant records
  • Use the Platform for any purpose other than legitimate professional advocacy or peer support services

9. Data Ownership

You retain ownership of all data you enter into the Platform, including participant records, documents, notes, and communications. Goliath Advocacy, LLC does not claim ownership of your data. We process your data solely to provide the Platform's services as described in our Privacy Policy. Upon account termination, you may request an export of your data within 30 days before it is permanently deleted.

10. Intellectual Property

The Platform, including its design, features, code, training content, COMPASS framework implementation, and all other proprietary content, is the intellectual property of Goliath Advocacy, LLC and is protected by applicable copyright, trademark, and other laws. You may not copy, modify, distribute, reverse engineer, or create derivative works based on the Platform without our express written permission. The ATLAS name, logo, and associated marks are trademarks of Goliath Advocacy, LLC.

11. Training Content

The training courses, lessons, and educational materials available through the Platform's Training Portal are proprietary content owned by Goliath Advocacy, LLC. You may access and use this content for your own professional development and for training staff within your organization. You may not reproduce, distribute, resell, or create derivative works from this content without express written permission.

12. Disclaimers

The Platform is provided "as is" without warranties of any kind, express or implied. Goliath Advocacy, LLC does not warrant that the Platform will be uninterrupted, error-free, or completely secure.

The Platform does not provide legal, medical, clinical, or professional advice. The training content, glossary, resource library, and AI-generated communications are informational tools only and do not constitute professional advice of any kind.

The Platform is a tool to support professional advocacy and peer support work — it does not replace the professional judgment, licensure, or credentials of qualified advocates, peer support specialists, educators, clinicians, or service providers.

13. Limitation of Liability

To the maximum extent permitted by law, Goliath Advocacy, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Platform, including but not limited to loss of data, loss of revenue, or professional liability arising from use of AI-generated content, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you for the Platform in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Goliath Advocacy, LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any applicable law or third-party rights.

15. Termination

We reserve the right to suspend or terminate your access to the Platform at any time for violation of these Terms, for non-payment, or for any other reason at our sole discretion, with or without notice.

You may terminate your account at any time by contacting us at legal@goliathadvocacy.com. Upon termination, your right to use the Platform ceases immediately. Data export and deletion terms are described in our Privacy Policy.

16. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or an in-app notification at least 14 days before the changes take effect. Your continued use of the Platform after such notice constitutes acceptance of the updated Terms.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law provisions. Any disputes arising under these Terms shall first be submitted to good-faith mediation before initiating legal proceedings.

Any legal proceedings shall be resolved exclusively in the state or federal courts located in Douglas County, Nebraska. You consent to personal jurisdiction in those courts.
